{"id":7778,"date":"2024-01-15T12:09:23","date_gmt":"2024-01-15T12:09:23","guid":{"rendered":"https:\/\/help.cleartalents.com\/index.php\/sexual-orientation-5\/"},"modified":"2024-01-17T23:44:20","modified_gmt":"2024-01-17T23:44:20","slug":"sexual-orientation","status":"publish","type":"page","link":"https:\/\/help.cleartalents.com\/help-pages\/be\/sexual-orientation\/","title":{"rendered":"Sexual Orientation"},"content":{"rendered":"\n<div class=\"wp-block-group has-global-padding is-layout-constrained wp-block-group-is-layout-constrained\">\n<p>Under employment equality legislation it is unlawful on the grounds of sexual orientation to discriminate directly against anyone \u2013 that is, to treat them less favorably than others because of their actual or perceived sexual orientation or because they associate with someone of a particular sexual orientation.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Sexual orientation can be defined as:<\/h2>\n\n\n\n<ul>\n<li>Orientation towards persons of the same sex (homosexual &#8211; now to be termed lesbian\/gay)<\/li>\n\n\n\n<li>Orientation&nbsp;towards persons of the other sex (heterosexual)<\/li>\n\n\n\n<li>Orientation towards persons of the same and the other sex (bisexual)<\/li>\n<\/ul>\n\n\n\n<p>However, the terms used for sexual orientation have become more numerous and nuanced. Thus, we must now assume that people who identify as asexual, pansexual, questioning and any other of the many terms to describe their sexual preference or orientation are covered by this legislation.<\/p>\n\n\n\n<p><strong>Note: The term \u2018Homosexual,\u2019 on the other hand, is now no longer considered acceptable. Thus \u2018Lesbian\u2019 and \u2018Gay\u2019 should be used instead.<\/strong><\/p>\n\n\n\n<p>These regulations apply to all forms of employment, training, recruitment, promotions, transfers, and dismissals.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">It is also unlawful to:<\/h2>\n\n\n\n<ul>\n<li>Discriminate indirectly against anyone \u2013 that is, to apply a criterion, provision or practice which disadvantages people of a particular sexual orientation unless it can be objectively justified<\/li>\n\n\n\n<li>Subject someone to harassment.
